Terms of Service

1. Use of the Site

You may use the Site to learn about our services, request a quote or estimate, and contact us. You agree to use the Site only for lawful purposes and not to:

• Submit false, misleading, or fraudulent information through any form on the Site
• Attempt to gain unauthorized access to the Site, our systems, or any connected accounts
• Use any automated system (bot, scraper, etc.) to access the Site in a manner that sends more request messages than a human could reasonably produce in the same time period
• Interfere with or disrupt the Site's functionality or security

‍

2. No Guarantee of Service Availability

We make reasonable efforts to keep the Site available and accurate, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Site at any time without notice.

‍

3. Quotes, Estimates, and Inquiries

Submitting a form on the Site (including our quote/estimate questionnaire) is an inquiry, not a binding contract for services. Any pricing, timelines, or financing terms referenced on the Site (including on our Financing page) are estimates or representative examples only and are subject to change based on an in-person inspection, credit approval (where applicable), material costs, and the specific scope of your project. Response times we mention on the Site or in confirmation emails are estimates, not guarantees. A binding agreement for services is only formed when you and USA Home & Commercial sign a separate written contract or work order.

‍

By submitting the quote/estimate questionnaire or any other form on the Site, you confirm that you have read and agree to these Terms and acknowledge our Privacy Policy.

‍

4. Financing Disclaimer

Financing options referenced on the Site are offered through third-party lending partners (such as Sunlight Financial), not directly by USA Home & Commercial. Rates, terms, and approval are determined solely by the lender based on creditworthiness and other factors, and are subject to change. Any rate or payment example shown on the Site is illustrative only and not a guaranteed offer. USA Home & Commercial is not a lender and does not make credit decisions.

‍

5. Intellectual Property

All content on the Site — including text, graphics, logos, photos, diagrams, and the overall design — is owned by USA Home & Commercial or used under license, and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission, except for personal, non-commercial reference (e.g., printing a page for your own use).

‍

6. Third-Party Services and Links

The Site uses or links to third-party services, including Google Analytics, Meta Pixel, Mapbox, Elfsight (reviews), Cloudflare Turnstile (spam protection), and Resend (email delivery). These services are governed by their own terms and privacy policies, which we encourage you to review. We are not responsible for the content, accuracy, or practices of any third-party service or linked website.

‍

7. Reviews and Testimonials

Reviews displayed on the Site are sourced from third-party platforms (such as Google) via the Elfsight widget and reflect the individual opinions of the reviewers, not guarantees of future results. Your experience may vary.

‍

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be error-free, secure, or uninterrupted.

This disclaimer applies to the Site itself and does not affect or limit any written warranty provided to you separately as part of an actual roofing, siding, window, or other service contract with USA Home & Commercial.

‍

9. Limitation of Liability

To the fullest extent permitted by law, USA Home & Commercial shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site shall not exceed one hundred dollars ($100).

This limitation does not apply to or affect any separate written service contract you may enter into with us for roofing, siding, window, or other home or commercial improvement services — that contract governs the work itself and any related warranties or liability terms.

‍

10. Indemnification

You agree to indemnify and hold harmless USA Home & Commercial, its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

‍

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Bexar County, Texas, and you consent to the jurisdiction of those courts.

‍

12. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
